Appellate Division Oral Argument of the Week: Does Denying a Father's Right to Communicate With His Son Due to the Father's Inability to Pay for Reunification Therapy Violate Due Process?


On Wednesday, April 29, judges on Part B of the Appellate Division will hear oral argument in Dornacker v. Laborante. The case is an unusual one.

Defendant, the appellant, is the father of a minor son with whom he was to be reunified. He filed his Appellate Division brief pro se. He argues that the Family Part denied him his due process rights when that court entered an order denying him any parenting or telephone contact with his son because defendant can no longer afford to pay a private reunification therapist. The American Civil Liberties Union of New Jersey, appearing as amicus curiae, filed a lengthy letter brief in support of defendant’s position. No one else has filed a brief in the Appellate Division.
