The Supreme Court announced that it has granted certification in M.R. v. Department of Corrections. The question presented, as phrased by the Supreme Court Clerk’s office, is “Under the Compassionate Release Act, N.J.S.A. 30:4-123.51e, are physicians required to physically examine an inmate when making a medical diagnosis to determine if the inmate is eligible for compassionate release?” In an opinion reported at 478 N.J. Super. 377 (App. Div. 2024), and summarized here, the Appellate Division ruled that no physical examination was required by any statute, regulation, or legislative history.
